Can You Get Disability and Retirement Benefits?

by Spencer & Spencer on March 23, 2012

We received this question from one of our readers:

Q: My dad is 73 years old and worked part-time. He got sick in January of a hernia and had surgery. During all the tests he had done they discovered he had lung cancer stage 3, which will be treated with radiation and chemo.  At his age (and he is receiving social security) would he qualify for disability?

A: No. Your father will not qualify for disability. The disability program is only for people who are younger than full retirement age. You cannot get both disability and retirement benefits from Social Security.

If you have a question about Social Security disability, please Ask A Lawyer.
